Coverage and Limitation of Liability
Towing and Roadside Assistance: 24-hour
emergency road service is provided when your vehicle
is disabled as long as your contract is in effect, and
is available only by calling 1-800-830-6466 (limit one
tow per disablement).
Mechanical First Aid:
Any service requiring a minor adjustment (exclusion
of parts) to enable a disabled vehicle to proceed under
its own power.
Battery Service: Attempting
to start a vehicle with a battery booster.
Delivery Service: Delivery
of emergency supplies of gasoline, oil, water and other
accessories and supplies as may be required and available
materials being delivered will be paid by the customer.
Towing Service: When
a vehicle is disabled, it will be hooked up and towed
up to 25 miles to a destination of your choice by an
authorized towing service.
Locksmith Service: If
keys are locked inside the covered vehicke, or if keys
are lost or broken, a locksmith will be dispatched.
FLAT Tires: Powerguard
will reimburse you for the charges incurred to repair
a flat tire caused by a road hazard while operating
vehicle on a public street and in a legal manner.
TIRE REPLACEMENT: You
will be reimbursed for the costs incurred to replace
a tire, only if a tire covered by this agreement becomes
unrepairable due to a road hazard. This coverage is
valid through the tread life of a tire (down to 2/32").
If a like tire is not immediately avilable, Administrator
Reserves the right to ship a similar tire of equal or
greater value to the original tire. Nowwishstanding
the immediate availablility of a like replacement tire,
Adminstrator reserves the right to ship a similar replacement
tire of equal or greater value than the damaged tire,
from its own stock. Tire inspection may be required
to validate claim approval.
WHEELS (RIMS): You will be reimbursed
for the repair or replacement of wheels rendered unservicable
due to a road hazard covered under this warranty. Wheel
inspection may be required to validate claim.
MOUNTING AND BALANCING: You will be
reimbursed for the cost of mounting, balancing and valve
stems for any tire replaced under this agreement.
TAXES: You will be reimbursed for the cost of local
and states taxes, as directed by state agencies for
any tire replaced under this agreement.
EMERGENCY TRAVEL EXPENSE:
We will reimburse you for emergency living expenses
for up to (3) days for cost of local loding and meals.
Maximum coverage is $50.00 per day while your vehicle
is being repaired provided the disablement results from
a tire adn wheel road hazard at least 250 miles from
your residence.
Any emergency road hazard feature is
limited to 5 maximum uses per contract period. It is
undersood that coverage afforded under this contract
applies only to any tire or wheel that is on the above
described vehicle, and that the terms, conditions, procedures
and limitations have been explained to me and are fully
understood.
What is NOT covered
An tire and wheel damange, which is covered by the contract
holder's primary insurance coverage or a vehicle service
contract. Replacement not authorized by Powerguard or
its agent prior to replacement, or; Replacement wherein
the manufacturer, by public announcement of a recall,
established its responsibility to replacement, or to
any manufacturer's defect. Replacement covered by a
warranty issued by the manufacturer of the tire on the
vehicle or; Unserviceable or unrepairable or failure
or less due to negligence (included driving with a flat
tire), abuse, misuse, or arising out of or related to
a collision, malicious mischief, vandalism, fire, chain
damage, racing, theft, improper inflation pressure,
or; Destruction of or damage to a tire due to impact
with a curb, off road vehicle use, or use on construction
site. These do NOT constitute road hazards. Destruction
of a tire in either the side wall or tread area due
to dry rot. Recreational vehicle registered and normally
operated outisde North America, or; Any consequential
loss or damage whosever, including loss, damage, or
injury to person or property resulting from the failure
of any of the parts of the vehicle described herein'
the replacement of which are covered under the terms
of the contract.
